OlaGate Terms of Service

Welcome to OlaGate!

These terms and conditions cover the use of “OLAGATE”, “OGCARE”, “OGCART”, “OGDESK”, “OGFOOD”, “OGCARE SP”, “OGGUEST”, “OGSECURITY”, mobile/desktop application and website designed, developed, owned and operated by gRhapa Services & Solutions Pvt. Ltd. (hereinafter referred to as “gRhapa” or “gRhapa Solutions” or “OlaGate”)

The information provided on the Services is non-proprietary information provided solely for the purpose of search and information for personal use by the User. By signing up and by using the Services, you hereby acknowledge that you have read and understood and agree to all the terms and conditions mentioned herein. If you do not accept the Terms & Conditions, please do not use the Services.

OlaGate reserves the right to modify, alter and make changes to these terms and conditions from time to time.

  1. DEFINITIONS

    1. "Account" - a password protected account created by the Service User, by providing a User ID, for access to the mobile/desktop application and/or website. The User may use their authenticated Facebook, Google or Twitter account to sign in.
    2. “Content” - means information or data made available on the platform and includes contact details, location, ratings, reviews, comments, images, photos.
    3. "Consumer(s)” - end users of mobile/desktop application and/or website of OlaGate who will avail the Services offered by the Service providers on the platform.
    4. "Booking Party" - Booking party refers to the service consumer and provider engaged through valid booking on the platform.
    5. "Information" - means data or information provided by the Users including personal and financial information.
    6. "Mobile/Desktop Application" - a mobile software or program namely OlaGate, designed, developed and owned by gRhapa Services & Solutions Pvt. Ltd. for use on a mobile communication device, which offers a social economic platform to connect Service Provider and Consumer for their mutual benefit. The Product link for the mobile application is https://olagate.app, it also available on play store & app store.
    7. "Platform" - mobile/desktop application called OlaGate or website of OlaGate.
    8. "Service Provider(s) (SP)" - those users, corporate entities, vendors, small medium enterprises, establishments or advertisers who are offering their services through mobile/desktop application and/or website of gRhapa Services & Solutions Pvt. Ltd by enlisting on the platform.
    9. "SP Agency" - refers to the agency providing services through hiring or contracting other individual service provider.
    10. "System Support" - Platform user with account type of "admin" and "bouser" are referred as a system support.
    11. "User" - the term includes service providers, Consumers, end users, browsers, merchants and traders who seek access to the mobile/desktop application or website shall be collectively referred to as User.
    12. "Website" - web-pages made available at https://olagate.app and includes sub-domains of OlaGate.
    13. "OlaGate AMS or OlaGate" - means the specific Portal of the specific Multi House Community or Society, accessible to Residents and Office Staff of only that Community or Society.
    14. "Association", "Community", "Society", "RWA", "HOA" are used interchangeably.
    15. "Banking partner", "Gateway", "Payment Gateway" refers to the third party applications or entities providing their services on or through OlaGate.
    16. "OlaGate AMS" and "OlaGate" - are used interchangeably to imply the Product that automates Workflows in Communities, Societies like Facility Management, Billing, Collection and Accounting etc.
    17. "OlaGate Gatekeeper" and "Gatekeeper" - are used interchangeably to imply the Product that automates workflow related to the Security Gate, Check-in Gate and is integrated with the OlaGate AMS.
    18. All "OlaGate", "OlaGate AMS", "OlaGate SP", "OlaGate SchoolBus", "OlaGate Gatekeeper" are Products of gRhapa Services & Solutions Pvt Ltd. gRhapa plays the role of a custodian for the information stored by the User via either of these Products on Servers maintained by gRhapa Solutions.
    19. "OlaGate ERP" which provided a closed based centralized database of multi dwelling unit, integrated with various tools for resident security, communication & engagement, vendor & facility management, billing & accounting
    20. "Vendor" refers to the individual user or agency signing up with the company to list and sell their products on OGCart ecommerce platform.
    21. "OGCare Open" refers to the version of OGCare which offers a subscription based license to use OGCare Platform for the subscribe period, to be used to self promote & manage individual services and/or business.
    22. "OGFood" refers to the application under OlaGate product suite, which helps small, medium or large establishments in the food industry to go online and start marketing their products & receive orders online.
    23. "OGFood App Subscriber" refers to the vendors, hotel, restaurants, cloud kitchen, dhaba, snacks center etc owner, manager or representative.
  2. ELIGIBILITY AND ACCEPTANCE OF TERMS

    Your use of services offered by OlaGate (referred to Services in this document) is subject to the terms of a legal agreement between you and OlaGate. This page explains how the agreement is made up, and sets out some of the terms of that agreement (referred as Terms of Service (TOS) in this document). The name 'OlaGate' has been used interchangeably with 'olagate.app'.

    In order to use the Services, you must first agree to the Terms. You may not use the Services if you do not accept the Terms of Use. You can accept the Terms by:

    1. By Clicking to accept or agree to the Terms, where this option is made available to you by OlaGate in the user interface for any particular Service or actually using the Services. In this case, you understand and agree that OlaGate will treat your use of the Services as acceptance of the Terms from that point onwards.
    2. By seeking access to information regarding Services displayed on the platform the User agrees that it is atleast 18 years of age, has attained majority and is competent to enter into a legally binding contract.
    3. By downloading the mobile/desktop application, accessing the website or clicking on “I Agree”, and by the use of the Services offered on the platform, the User agrees to be bound by these Terms and Conditions.
  3. PROVISION OF GRHAPA / OLA GATE

    1. OlaGate is constantly evolving in order to provide the best possible experience and information for its users. You acknowledge and agree that the form and nature of the Services which OlaGate provides may change from time to time without prior notice to you.
    2. As part of this continuing process, you acknowledge and agree that OlaGate may stop (permanently or temporarily) providing the Services (or any features within the Services) to you or to users generally at OlaGate's sole discretion, with or without prior notice to you. You may stop using the Services at any time. You do not need to specifically inform OlaGate when you stop using the Services.
    3. You acknowledge and agree that if OlaGate disables access to your account, you may be prevented from accessing the Services, your account details or any files or other content which is contained in your account.
    4. You acknowledge and agree that while OlaGate may not currently have set a fixed upper limit on the number of transmissions you may send or receive through the Services, such fixed upper limits may be set by OlaGate at any time, at OlaGate's discretion.
    5. By using OlaGate's services you agree to the following disclaimer: OlaGate disclaims any liability for any information that may have become outdated since the last time the particular piece of information was updated. OlaGate reserves the right to make changes and corrections to any part of the content of this website at any time without prior notice. Unless stated otherwise, all pictures and information contained on this website are believed to be in the public domain as either promotional materials, publicity photos, photoshoot rejects or press media stock. Please email a Takedown Request (by using the Contact Us on the home page) to the webmaster under the terms of the Digital Millennium Copyright Act if you are the copyright owner of any content on this website and you think the use of the above material violates the Copyright act in any way. Please indicate the exact URL of the webpage in your request. All images shown here have been digitised by OlaGate. No other party is authorised to reproduce or republish these digital versions in any format whatsoever without the written permission of OlaGate.
    6. Service Providers can create and list any service for offering it on the platform for viewing, browsing and selection by the Consumers. Service Providers are required to provide details of location, contact, rates, nature of service or any other information that may be required for the Consumers to avail the service.
    7. OlaGate admin will reserve the right to review, edit, activate, deactivate, suspend services created by the User if found duplicate or inappropriate.
    8. The Users are allowed to post, comment, share, submit, send or receive content through the platform.
    9. OlaGate does not claim ownership & authenticity of the information provided by users. OlaGate takes no responsibility for false information or mis representation by the User.
    10. OlaGate does not claim ownership of any content provided by Users that is posted or listed on the platform except in the database or compilation rights which shall be vested in OlaGate.
    11. You understand that all information (such as data files, written text, audio files, images or any other media) which you may have access to as part of, or through your use of the Products of gRhapa Solutions are the sole responsibility of the person from which such content originated. gRhapa Solutions takes no responsibility for abusive content, and it is the responsibility of the users to regulate such content. gRhapa Solutions takes no responsibility for any data generated within any of its Products and published or distributed outside by the user.
    12. In case of OlaGate Gatekeeper usage the Association and Administrative Users take responsibility to treat the Visitor Data with the same Privacy and Sanctity that they do for Visitor Data captured prior to use of OlaGate Gatekeeper. gRhapa Solutions takes no responsibility for any data captured in OlaGate Gatekeeper and published or distributed outside by any User having access to such Data.
    13. gRhapa Solutions reserves the right to suspend its service to Users involved in service abuse.
    14. The OlaGate, OlaGate ERP, OlaGate SP, OlaGate Gatekeeper, all products are integrated with each other. Depending on the access available to You, You may use any or all of these Products. Up-to-Date information on the Service Offerings are found on the Pricing Link of the website.
  4. ACCOUNT REGISTRATION

    1. Service Provider is required to sign up and register on the platform in order to provide services. Consumers will be required to sign up on the first booking. While Conumer who wish to OlaGate AMS needs signup as a resident and register their society/community with their Unix.
    2. The Consumer may visit the platform without registration. An Account will be required to be created by the Consumer for availing the Services made available on the platform.
    3. By providing your email and/or phone number, you agreed to receive email and/or text (sms) messages of all type from OlaGate and its parent company gRhapa. You can unsubscribe for both email and sms at your will.
    4. In order to use the OlaGate AMS Platform, a user must first complete the registration form. During registration a user is required to give their contact information and proof of being associated with the Multi Dwelling Unit. The registration information given by the user must always be accurate, correct and up to date. This ensures the User can get the maximum benefit from the Product.
    5. The User is required to provide its name, contact information, preferences and any other additional information for account registration. To subscribe to a certain Service offered by the OlaGate on its platform, the User is required to sign up by creating a User ID and password. Alternatively, the User can register using its existing Facebook or Google or Twitter account.
    6. The User is required to provide accurate, authentic correct information and shall be responsible for maintaining the security of Password.
    7. An individual Service Provider may have to pay one time registration fees to access the platform. OlaGate may charge them the commission or licensing fee or lead fees or subscription fees, which may vary from service to service. OlaGate however, reserves the right to offer paid premium accounts to the Service Provider or to SP agencies or to collaborative group of SP contractors/sub-contractors/agencies.
    8. Services provided on the platform are free for Consumers. OlaGate reserves the right to charge subscription or membership fees to the Consumer in respect of any premium service made available on the Platform.
    9. OlaGate reserves the right to reject registration application of service provider if any inconsistency found in the supporting documentation or external feedback about the character of the service provider.
    10. OlaGate reserves the right to suspend, limit or disable access to the Account and prevent the User from accessing OlaGate platform.
    11. The User will be responsible for all activity that occurs on the Account and shall notify OlaGate immediately of any breach or unauthorized used. The Users alone will be responsible for safeguarding the password and keeping it secure.
    12. Service Provider shall be required to submit their Government approved identity document like Adhar number / Driving License / PAN Card / Election Card etc for the purpose of verification of identity by OlaGate.
    13. OlaGate reserves the right to ask for additional supporting documentation to validate the authenticity of the application.
    14. OlaGate reserves the right to ask for government , legal , police verification document , which service provider will need to procure personally at his/her own expense and will not be covered in OlaGate registration charges.
    15. The User stores information about himself/herself under his/her User Profile. Information provided is available to the User and the Administrative Users belonging to the same community/society as the user. The Visitor information entered in GateKeeper is available to the Unit to which the Visitor is visiting, and to the Administrative Users belonging to the same community/society Unit as the user. The Domestic Staff information entered in gGateKeeper is available to the Prop Unit in which the specific Domestic Staff member works and to the Administrative Users belonging to the specific Multi Dwelling Unit. The Vendor information entered is available to the Administrative Users belonging to the specific community/society. Administrative Users may also enter Personal Information of the Users. gRhapa Solutions takes no responsibility for the accuracy of such data entered by the Users or Administrative Users.
  5. TERMS OF USE OF CONTENT

    1. The Content made available on the Platform displayed on the listing page is for information purposes only. Unless you have agreed otherwise in writing with OlaGate, nothing in the Terms gives you a right to use any of OlaGate's trade names, trade marks, service marks, logos, domain names, and other distinctive brand features.

      Unless you have been expressly authorized to do so in writing by OlaGate, you agree that in using the Services, you will not use any trade mark, service mark, trade name, logo of any company or organization in a way that is likely or intended to cause confusion about the owner or authorized user of such marks, names or logos.

    2. OlaGate grants to its Users a personal, non-exclusive and non-transferable license to access and use the Services only as expressly permitted under these terms and conditions.
    3. The Users undertake to provide real, authentic, correct and verifiable information connected with OlaGate. OlaGate is not liable for any misrepresentation or information that has become outdated.
    4. The information shared by the User enables OlaGate to provide personalized and customizable services. OlaGate may collect and use the information provided by the Users for evaluating user preferences, advertising and marketing purposes.
    5. The User agrees not to use, reproduce, mis-use, duplicate, sell or exploit any part of the Service offered on the mobile/desktop application or website.
    6. The User may not use the Services to publish or distribute any information which is illegal or which infringes upon the rights of any third party or which is confidential, abusive, pornographic, racial, discriminatory or hate spreading or otherwise offensive.
    7. OlaGate mere provides the platform for consumer and service provider & does not guarantee the quality of services or goods made available through the Platform. OlaGate does not make any warranties about the validity, reliability and accuracy of the Content.
    8. OlaGate does not knowingly collect or solicit personal information from anyone under the age of 18. If a User under 18 attempts to register of Services or send any personal information about them to OlaGate, OlaGate reserves the right to delete such information from its platform. If the User believes that a child under 13 may have provided OlaGate with personal information, he/she may send an email at [email protected].
    9. Any reliance by the User upon the information will be at the User’s own risk and OlaGate will in no way be responsible or liable for any cost or damage or losses incurred by the action or non-compliance of the User.
    10. The User accepts that OlaGate may modify, alter, change, suspend, restrict, terminate or revoke its Services or any terms under these Terms and Conditions at any time without notice to the Users.
    11. Any new features which are added to the current mobile application or website shall also be subject to these Terms and Conditions. The User may be required to install updates to the mobile/desktop application to continue access to and use of OlaGate.
    12. The User agrees not to mine or use any personally identifiable data such as name and account information from the platform for commercial benefit or making illegal gains.
    13. Users may be allowed to post, share or contribute content to OlaGate Platform. The Users shall be responsible for the authenticity of any file or information uploaded by them on the OlaGate Platform from his/her device. The Users shall be solely responsible for any private media uploaded from their device. The media files uploaded on the OlaGate platform will be publicly accessible. OlaGate may access or use the media files for analytics and marketing purposes.
    14. The User agrees to report any issue with the platform promptly to help improve the platform.
    15. You hereby acknowledge and agree that OlaGate may monitor and record any chat messages exchanges between the Booking Parties. OlaGate admin may have access to the chat sessions between the Booking Parties. These chat messages available to the Booking Party through the booking history view. The recorded chat messages may also be used for further analysis to improve the platform, build analytics etc.
  6. TERMS FOR SERVICE PROVIDERS / VENDORS / B2B PARTNERS / OGFOOD APP SUBSCRIBER

    1. By registering on the platform as a Service Provider, you agree to promptly respond to a service request or a booking request submitted by the client on the OlaGate platform.
    2. By responding to a service request or a booking request on the OlaGate platform, the Service Provider agrees that OlaGate may send an informational text (SMS) message or an app notification to the contact number provided by the Service Provider.
    3. The Service Provider agrees to provide services or products at the mutually agreed rate listed on the platform, while for lead and store based services Service provider must offer a discounted rates, to the OGCart Consumers on the Platform.
    4. The Service Provider shall be responsible for the authenticity of any file or information uploaded by them on OlaGate platform from his/her device.
    5. The Service Provider agrees to accept the service rates & rate factor provided by the platform for off-hours the services offered on the platform. Service Provider is bound to provide service during off hours but can opt out off hours services at any time. However, the Service Provider will be bound to provide service for any previously booked off-hour services.
    6. The Service Provider agrees to behave professionally with the Consumer and the members of his/her family. The Service Provider will respect the privacy of the Consumer in all respects.
    7. The Service Provider agrees to the terms of usage mentioned herein including any changes made to it at any time.
    8. The Service Provider agrees not to put pressure or force or coerce the Consumer to accept its services.
    9. The Service Provider agrees with the terms of that platform reserves the right to suspend or deactivate his account with or without any explanation.
    10. The Service Provider agrees not to outsource its service activities to non platform user.
    11. The Service Provider agrees to submit a quotation and raise invoice from the platform. The Service Provider acknowledges that the quotation may be subjection to acceptance by the Consumer.
    12. The Service Provider agrees and acknowledges that through the platform OlaGate merely provides visibility to the Services offered by the Service Provider and is not responsible for providing it guaranteed services. Consumer feedback will drive the service booking.
    13. The Service Provider agrees to use the platform in a legal and acceptable way.
    14. The Service Provider agrees that OlaGate reserves right to calculate the rating, points and rewards. OlaGate reserves the right to use its own algorithm/formula to calculate the rating & rewards point using multiple factors like consumer/customer feedback/review, years on platform, educational qualification, years of experience, professional certificate etc. OlaGate is not bound to disclose its algorithm /formula.
    15. The Service Provider agrees that OlaGate will make client review and feedback open for public viewing on its platform.
    16. The Service Provider agrees that OlaGate is not responsible for any monetary losses incurred due to outage of the platform.
    17. The Service Provider while registering with OlaGate, to undertake that it has no past criminal record and that there are no criminal proceedings pending against it before any authority. OlaGate may require pre-police verification of the Service Provider or may conduct such verification on its own or through any third party before allowing the Service Provider to register on OlaGate. In case of failed police verification, OlaGate reserves the right to suspend or deactivate the account of the Service Provider without any explanation.
    18. OlaGate administrator will have access to the user profile of the Service Provider and shall remove, delete, modify, suspend or deactivate the account if any material that is obscene or likely to hurt religious or moral sentiments of persons, is uploaded or posted by the Service Provider.
    19. OlaGate reserved the right to charge lead fees, subscription fees, licensing fees and/or commission per booking.
    20. OlaGate reserve rights to revise the premium account fees & structure, at any point of time without notification, to be applicable for new users or on renewal of premium account.
    21. Service provider agrees that he/she has rights to switch between premium and free account. He/She agreed that every time account switched from premium to free, access to platform, visibility on the platform & access to premium features will be unavailable completely or partially as decided by OlaGate on that point of time.
    22. OlaGate reserves right to control the list & the order of SP visible to client or on broadcast for the broadcast &/or lead services.
    23. OlaGate reserves rights to add, remove, update features in the service provider premium service provider account .
    24. OlaGate reserves rights to roll out & roll back the offers for service provider during it's normal course of business.
    25. OGCart vendor agrees to do timely delivery of quality product to the customer, if this condition is not met vendors agrees to refund the customer money directly or agrees to honor OGCart charge back for the same amount.
    26. OGCare Open platform, which is offered on subscription basis does not guarantee any clients to service providers. It merely provides a platform to be used as a business tool to effectively manage and promote individual services or business of agencies.
    27. The subscription fees paid for the usage of OGCare Open platform is a license fee & fully non refundable.
    28. OGCare Open is being offered on subscription basis in limited districts or counties decided by OlaGate & it reserved the right to terminate the subscription based model or change to credit based model or to any other working model, at any time without any prior notice. In such action OlaGate will honor the subscription payment by continuation of service or refund of prorated subscription fees or convert the paid subscription into equivalent credit.
    29. OGCare SP or OGCare SPA, on the Open platform solely responsible for his or her own action & behavior at client site or any other private or public place.
    30. OGFood App, is offered on subscription basis & it does not guarantee any clients to vendors or B2B partners. It merely provides a platform to get their business online quickly and attract customers digitally. You will be solely responsible for any wrong listing, incorrect menu, prices, pictures upload on the platform.
    31. OGFood App subscription will get you the marketable link for your business with a dedicated page listing your menu or items but you are solely responsible for marketing your online presence using your own network and social media presence.
    32. Rating and Review provided by OGFood consumers are solely based on their own discretion & experience. OlaGate does not have any influence or role in those reviews and ratings. It is advisable to vendors or OGFood App subscribers to deliver quality of food and good service to earn reputation.
    33. OGFood App, neither delivers any food items nor provides any delivery service. If you hire delivery boys on OGCare platform those will be freelancers and representatives of themself not the OlaGate.
    34. You agree that you will not use OGFood Platform/App for selling any organic or nonorganic items or products, which are banned for the online sale by local, state or federal/central government.
    35. If it comes to our attention that you are selling any item banned for online sale, listed on OGFood, we reserve the right to remove the item or bring down online store, send notice, take legal action in the competent courts/tribunals having jurisdiction in Nagpur in India.
    36. You are solely responsible and liable for any legal action, penalties resulting from listing or selling, any banned or illegal item on OGFood Platform/App.
    37. We do not scan through any establishment online menu published on OGFood proactively, but we reserve the right to do so on any incident reported to through proper channel & procedure or on the request and take appropriate action if any non compliance item or product listed.
    38. Thank you for your interest in our product and taking advantage of our 14-day free trial. Please read the following clause regarding our no refund policy for the product:
      6.40.1. No Refunds:
      a. Once the 14-day free trial period has ended, no refunds will be provided for any reason, including but not limited to customer dissatisfaction, change of mind, or personal circumstances.
      b. By proceeding with the purchase after the free trial, you acknowledge and agree that the purchase is final and non-refundable.
      6.40.2. Trial Period Evaluation:
      a. The 14-day free trial is designed to give you sufficient time to evaluate the product before making a purchasing decision.
      b. We encourage you to fully utilize the trial period to assess the product's features, performance, and suitability for your needs.
      6.40.3. Technical Support:
      a. If you encounter any technical issues during the trial period, please reach out to our customer support team for assistance.
      b. We will make reasonable efforts to address and resolve any technical issues promptly.
      6.40.4. Modification or Cancellation:
      a. You have the option to modify or cancel your subscription at any time before the trial period ends to avoid any subsequent charges.
      b. Please ensure you follow the instructions provided to modify or cancel your subscription to prevent any future billing.
      6.40.5. Additional Terms:
      a. Any additional terms and conditions related to the product, including usage restrictions and licensing agreements, will remain in effect even if you choose not to proceed with the purchase after the free trial.
      b. By using the product beyond the free trial period, you agree to abide by all applicable terms and conditions.
      6.40.6. Changes to Terms:
      a. We reserve the right to modify, alter, or update this refund policy at any time without prior notice.
      b. Any changes to the refund policy will be effective immediately upon posting on our website.
      If you have any questions or concerns about our no refund policy, please contact our customer support team before the end of the free trial period.
  7. TERMS FOR CONSUMERS

    Subject to overall provision paraphrased above, you expressly understand and agree that OlaGate, its subsidiaries and affiliates, and its licensors shall not be liable to you for:

    1. Any direct, indirect, incidental, special consequential or exemplary damages which may be incurred by you, however caused and under any theory of liability. This shall include, but not be limited to, any loss of profit (whether incurred directly or indirectly), any loss of goodwill or business reputation, any loss of data suffered, cost of procurement of substitute goods or services, or other intangible loss.
    2. Any loss or damage which may be incurred by you, including but not limited to loss or damage as a result of Any reliance placed by you on the completeness, accuracy or existence of any advertising, or as a result of any relationship or transaction between you and any advertiser or sponsor whose advertising appears on the services
    3. The deletion of, corruption of, or failure to store, any content and other communications data maintained or transmitted by or through your use of the service
    4. Your failure to provide OlaGate with accurate account information
    5. Your failure to keep your password or account details secure and confidential
    6. The limitations on OlaGate's liability to you in paragraph 7 above shall apply whether or not OlaGate has been advised of or should have been aware of the possibility of any such losses arising.
    7. You agree to use the platform in a legal and acceptable way.
    8. You agree that OlaGate is not responsible for any monetary or non monetary losses incurred due to outage of the platform.
    9. You agree to reviews and ratings provided on the platform will be an expression of their honest opinion and should not be with an intention to malign or target the Service Provider. OlaGate reserves the right to take down such reviews, comments and posts which are defamatory or otherwise in contravention of these terms and conditions.
    10. You agree to help the community and neighborhood through review and feedback on the Service Provider.
    11. You agree not to hold OlaGate responsible for any kind of misconduct by the Service Provider.
    12. You understand and agree that the OGCare back warranty is valid only for the specified service providers and when in App online payment is made in full. In all other bookings OGCare back warranty is not applicable and can not be claimed.
    13. Food items listed and sold on OGFood are directly listed, prepared and sold by vendor or OGFood App subscribers. The gRhapa or OlaGate is not responsible for any issues listed but limited as below
      wrongdoing, food poisoning, for any religious food protocol, wrong delivery of food, incorrect ingredients, bad quality of food, overcharging, payment issue, refund issues, delivery delay etc.
    14. Payment & Refund
      When using the Services, you are required to make payments for orders. By using the Services, you agree that OlaGate has the immediate authorization to charge your credit card (or any other approved payment facility) for the payment of any order placed using your Password (as defined below).
      It is important to maintain strict confidentiality of your Password, as explained in more detail in Section 8 below. You are responsible for all activities and charges incurred under your Password. Your liability for such charges shall remain even after the termination of this Agreement.
      If you have any questions regarding a transaction appearing on your credit card statement, please utilize the "Contact Us" section of the Website to get in touch with our customer service.
      All refund requests are subject to the refund policies established by the restaurants from which you have placed your order. In the event that you contact us seeking a refund, we are unable to process any refund until we receive approval from the relevant restaurant. We will make reasonable efforts to request and obtain refunds when deemed appropriate.
      As an entity, OlaGate holds responsibility for the security of cardholder data received from our customers, if applicable. Any storage, processing, or transmission of cardholder data is conducted in compliance with the most current version of the Payment Card Industry Data Security Standard
  8. INTELLECTUAL PROPERTY

    1. Unless otherwise indicated, gRhapa owns the copyright in the software, design and content made of the platform including listings. Users must not reproduce, adapt, store in a retrieval system, transmit, print, display, perform, publish or create derivative works from any part of the gRhapa Services or the content made available via the platform, including for commercial purposes or for commercial gain.
    2. All trade marks, logos, images, products and company names referred to or made available via the platform are the property of their respective owners.
  9. DISCLAIMER

    1. The Platform may contain advertisements and third party content.
    2. gRhapa does not guarantee, represent or warrant that your use of gRhapa Services will be uninterrupted, timely, secure or error-free. gRahpa does not make any representations about the accuracy or suitability of the content provided on the Platform. The information is provided ‘as is’, without express or implied warranty.
    3. “OlaGate” is the trademark of gRhapa Services & Solutions Pvt Ltd, a company incorporated under the Companies Act, 1956, having its registered office at 194, Cement Road, Dharampeth Extension Nagpur MH 440010 IN & have no connection or relationship with Ani Technologies Pvt Ltd and any other companies with registered trademark starting with letters “OLA”.
    4. OlaGate, the Acquiring Banks and the Facility Providers disclaim all warranties, express or implied, written or oral, including but not limited to warranties of merchantability and fitness for a particular purpose. The Society acknowledges that the OlaGate, the Facility Providers and the Acquiring Bank’s services may not be uninterrupted or error free. The Society also acknowledges that the services provided by the Acquiring banks and the facility providers to OlaGate which is passed on to the Society under the payment gateway agreement, can be in any event be brought to an abrupt end in any event whatsoever by any of the acquiring banks or the facility providers for any reason whatsoever.
    5. OlaGate’s sole obligation and the Society’s sole and exclusive remedy in the event of interruption to the Services or loss of use and/or access to the Products of OlaGate, the facility Providers facilities and the Acquiring Bank’s Payment Mechanism and services, shall be to use all reasonable endeavors to restore the Services and/or access to the Payment Mechanism as soon as reasonably possible.

      Without prejudice to any other provision of this Agreement, OlaGate, the Facility Providers and the Acquiring Banks does not warrant that: - a. The Products of OlaGate, the facility providers facilities and the Acquiring Bank’s Payment Mechanism will be provided uninterrupted or free from errors or that any identified defect will be corrected; or b. is free from any virus or other malicious, destructive or corrupting code, program or macro; or

    6. For the avoidance of doubt, in no event shall OlaGate, the Facility Providers and the Acquiring Banks be liable to the Association or any other third party for any of the following: a. amounts due from payment gateway User in connection with any service obtained by the payment gateway User from the Association; b. any applicable taxes and Government levies;
  10. COOKIE POLICY

    1. OlaGate collects information through the use of “cookies” on its platform. Cookies enable websites to function more efficiently and provide information to OlaGate and help it remember certain information about the User either for the duration of the visit or repeated visits.
    2. The cookies used by OlaGate on its platforms are of the following types:
      • Strictly Necessary cookies, which are required to enable you to use the website;
      • Performance cookies, to collect anonymous, non-personally identifiable information about the usage of the website which enable us to continually enhance and optimise its performance;
      • Functionality cookies, to remeber your preferences;
      • Marketing cookies, to show you offers based on your interests.
    3. The User can accept or decline cookies by changing their browser settings.

  12. INDEMNIFICATION

    The User agrees to indemnify and hold harmless OlaGate and its partners, officers, directors, agents and employees, from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of the User’s breach of these Terms and Conditions or by violation of any law or the rights of a third-party by the User or dispute between two or more registered users of the platform.

  13. SEVERABILTY

    In the event that any provision of these Terms and Conditions is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and such determination shall not affect the validity and enforceability of any other remaining provisions.

  14. GOVERNING LAW

    This Agreement will be governed by and construed in accordance with the laws of India. The Users agree that any legal action or proceedings arising out of this Agreement may be brought exclusively in the competent courts/tribunals having jurisdiction in Nagpur in India and irrevocably submit themselves to the jurisdiction of such courts / tribunals.
